Trump Administration Plans to Appeal Supreme Court Ruling on Tariff Refunds

Following the Supreme Court's decision that President Trump lacked the authority to impose higher tariffs, businesses have started receiving refunds for duties paid, with Customs and Border Protection processing claims totaling $85 billion. As of May 22, the agency had directed $20.6 billion in refunds.

However, the Trump administration announced plans to appeal a federal judge's order that allows all companies to seek refunds, which could halt the refund process. The judge, Richard K. Eaton, is seeking clarity on the timeline for repaying approximately 330,000 eligible importers.

The Justice Department argues that the appeal is necessary and that the CBP needs technological upgrades to handle older claims. Retail giants like Walmart and Costco plan to use their refunds to lower prices for consumers, while smaller businesses express the need for these funds to stabilize financially after the burdensome tariffs.
